1. The case originated in an application (no. 24699/94) against the Swiss Confederation lodged with the European Commission of Human Rights (“the Commission”) under former Article 25 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by VgT Verein gegen Tierfabriken, an association registered in Switzerland (“the applicant association”), on 13 July 1994.

2. Minelli, a lawyer practising in Forch, Switzerland. The Swiss Government (“the Government”) were represented by their Agent, Mr P. Boillat, Head of the International Affairs Division of the Federal Office of Justice.

3. The applicant association alleged that the refusal to broadcast a commercial had breached Article 10 of the Convention. It further complained that it had no effective remedy within the meaning of Article 13 at its disposal to complain about this refusal. The applicant association also complained of discrimination contrary to Article 14 in that the meat industry was permitted to broadcast commercials.

4. The application was transmitted to the Court on 1 November 1998, when Protocol No. 11 to the Convention came into force (Article 5 2 of Protocol No. 11).

5. The application was allocated to the Second Section of the Court (Rule 52 1 of the Rules of Court). Within that Section, the Chamber that would consider the case (Article 27 1 of the Convention) was constituted as provided in Rule 26 1.

6. By a decision of 6 April 2000 the Court declared the application partly admissible [Note by the Registry. The Court’s decision is obtainable from the Registry].

7. The applicant association and the Government each filed observations on the merits (Rule 59 1). After consulting the parties, the Chamber decided that no hearing on the merits was required (Rule 59 2 in fine).


8. The aim of the applicant association is the protection of animals, with particular emphasis on animal experiments and industrial animal production.

9. As a reaction to various television commercials of the meat industry, the applicant association prepared a television commercial lasting fifty five seconds and consisting of two scenes.

10. The first scene of the film showed a sow building a shelter for her piglets in the forest. Soft orchestrated music was played in the background, and the accompanying voice referred, inter alia, to the sense of family which sows had. The second scene showed a noisy hall with pigs in small pens, gnawing nervously at the iron bars. The accompanying voice stated, inter alia, that the rearing of pigs in such circumstances resembled concentration camps, and that the animals were pumped full of medicaments. The film concluded with the exhortation: “Eat less meat, for the sake of your health, the animals and the environment!”

11. On 3 January 1994 the applicant association, wishing this film to be broadcast in the programmes of the Swiss Radio and Television Company (Schweizerische Radio und Fernsehgesellschaft), sent a videocassette to the then Commercial Television Company (AG fr das Werbefernsehen, now called Publisuisse) responsible for television advertising.

12. On 10 January 1994 the Commercial Television Company informed the applicant association that it would not broadcast the commercial in view of its “clear political character”. The company pointed out that an alternative solution would be a film showing the merits of a decent rearing of animals and informing viewers that they were free to enquire into the origin of the meat which they were buying.

13. By a letter of 10 January 1994 the applicant association requested a decision against which it could file an appeal. Nevertheless, it would be willing to convene a meeting to discuss other possibilities in the presence of a legal adviser.

14. By a letter of 14 January 1994 the applicant association stated that it was not prepared to accept changes to its commercial.

15. By a letter of 24 January 1994 the Commercial Television Company declined the applicant association’s requests as follows:

“As you have refused the discussion which we have proposed, we see no reason to enter into your propositions as set out in your letters of 14 and 20 January 1994. We regret this development as it serves neither you nor us. We confirm that we cannot broadcast your commercial in the proposed form as it breaches section 14 of the Radio and Television Ordinance [Radio und Fernsehverordnung] as well as our general conditions of business [Allgemeine Geschftsbedingungen]. In addition, the Commercial Television Company cannot be obliged to broadcast commercials which damage its business interests and involve its editorial rights.”

16. On 4 February 1994 the applicant association filed a complaint with the Independent Radio and Television Appeal Board (Unabhngige Beschwerdeinstanz fr Radio und Fernsehen), complaining of the refusal to broadcast the commercial. The latter informed the applicant association on 10 February 1994 that it could only deal with appeals complaining about programmes which had already been broadcast, but that it would transmit the complaint to the Federal Office of Communication (Bundesamt fr Kommunikation). The Federal Office informed the applicant association on 25 April 1994 that within the framework of the broadcasting provisions the Commercial Television Company was free to purchase commercials and choose its contractual partners as it wished. It further stated that it considered the complaint to be a disciplinary report, and that it saw no reason to take proceedings against the Swiss Radio and Television Company.

17. On 6 July 1994 the applicant association filed a complaint with the Federal Department of Transport, Communications and Energy (Eidgenssisches Verkehrs und Energiewirtschaftsdepartement), which was dismissed on 22 May 1996. In its decision, it found, inter alia, that the Swiss Radio and Television Company was the sole institution to provide information in respect of home news (Inlandsberichterstattung). In respect of commercial broadcasts, however, the company was in competition with local, regional and foreign broadcasters,

and the applicant association was not obliged to have its commercial broadcast over the channels of the company. Moreover, the company acted in matters of advertising as a private entity and did not fulfil a duty of public law when it broadcast commercials. The Federal Department concluded that the Swiss Radio and Television Company could not be ordered to broadcast the commercial at issue.

18. The applicant association’s administrative law appeal (Verwaltungsgerichtsbeschwerde), filed by a lawyer and dated 18 June 1996, was dismissed by the Federal Court (Bundesgericht) on 20 August 1997. The court noted, with reference to Article 13 of the Convention, that the Federal Office of Communication should have formally afforded the applicant association the opportunity to institute complaints proceedings which, if necessary, could have remedied the matter. As the case was ready for decision, the Federal Court undertook the decision itself. It then balanced the various issues at stake.

19. The judgment proceeded to explain the position of the Swiss Radio and Television Company in Swiss law. The company no longer enjoyed a monopoly and was increasingly subject to foreign competition. However, this did not alter the fact that, according to the applicable law, the Swiss Radio and Television Company continued to operate in the area of programming within the framework of public law duties with which it was entrusted. The law itself granted it a licence for the broadcasting of national and linguistic regional programmes.

20. The Federal Court further considered that Article 55 bis 3 of the Federal Constitution (Bundesverfassung); in the version applicable at the relevant time, ensured the independence of radio and television broadcasting as well as autonomy in programming. However, advertising fell outside the programming obligations of the Swiss Radio and Television Company, the programming activity presupposing an assessment of the informative content by an editor. Only programming activities were covered by Article 55 bis of the Federal Constitution and section 4 of the Federal Radio and Television Act (Bundesgesetz ber Radio und Fernsehen). Viewers should not be influenced in their opinions by one sided, unobjective or insufficiently varied contributions which disregarded journalistic obligations. Commercials, on the other hand, were by their very nature onesided as they were in the interest of the advertiser, and were by definition excluded from a critical assessment. For this reason, pursuant to section 18(1) of the Federal Radio and Television Act, they had to be clearly separated from programmes and recognisable as such. Indeed, the Federal Radio and Television Act dealt with advertising and financing, rather than with programming. The judgment continued:

“Until 1964 [advertising] was completely prohibited on radio and television.

Subsequently, it was allowed on television, although it was subject to restrictions in the interests of an optimal implementation of programming duties and to protect other important public interests (youth, health, diversity of the press). Section 18 of the Federal Radio and Television Act today assumes in principle that advertising is admissible but subject to certain limitations. Thus, section 18(5) of the Federal Radio and Television Act prohibits religious and political advertising as well as advertising for alcoholic beverages, tobacco and medicaments. of the Radio and Television Ordinance. These provisions contain no obligation whatsoever to broadcast commercials, and do not declare that advertising is a public law duty of the broadcaster.”

21. In respect of the applicant association’s complaint under Article 10 of the Convention, the Federal Court found that the prohibition of political advertising laid down in section 18(5) of the Federal Radio and Television Act served various purposes:

“It should prevent financially powerful groups from obtaining a competitive political advantage. In the interest of the democratic process it is designed to protect the formation of public opinion from undue commercial influence and to bring about a certain equality of opportunity among the different forces of society. The prohibition contributes towards the independence of the radio and television broadcasters in editorial matters, which could be endangered by powerful political advertising sponsors. According to the Swiss law on communication the press remains the most important means for paid political advertising. The Federal Court observed that the applicant association had other means of disseminating its political ideas, for instance in foreign programmes which were broadcast in Switzerland, or in the cinema and the press. The Commercial Television Company had offered the applicant association other possibilities and was also willing to convene a meeting to discuss them with it in the presence of a legal adviser.

23. In respect of the applicant association’s complaint about discrimination, the Federal Court found that it was complaining of two situations which were not comparable with each other. Promotions by the meat industry were economic in nature in that they aimed at increasing turnover and were not related to animal protection. On the other hand, the applicant association’s commercial, exhorting reduced meat consumption and containing shocking pictures, was directed against industrial animal production. The applicant association was frequently active in the media in order to pursue its aims. In 1992 it had filed a disciplinary complaint in this respect with the Swiss Federal Parliament. The matter became a political issue early in 1994 when the Swiss Federal Council commented on the matter.

1. The case originated in an application (no. 16354/06) against the Swiss Confederation lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by an association constituted under Swiss law, Mouvement ralien suisse (“the applicant association”), on 10 April 2006.

2. The applicant association was represented by Mr E. Elkaim, a lawyer practising in Lausanne (Switzerland). The Swiss Government (“the Government”) were represented by their Agent, Mr F. Schrmann, of the Federal Office of Justice.


4. The application was allocated to the First Section of the Court (Rule 52 1 of the Rules of Court). On 15 May 2008 the Court decided to give notice of the application to the Government and, under former Article 29 3 of the Convention, to examine the admissibility and merits at the same time.

5. On 13 January 2011 a Chamber of that Section composed of the following judges: Christos Rozakis, Nina Vaji, Khanlar Hajiyev, Dean Spielmann, Sverre Erik Jebens, Giorgio Malinverni and George Nicolaou, and also of Sren Nielsen, Section Registrar, delivered a judgment in which it found, by five votes to two, that there had been no violation of Article 10 of the Convention and that there was no need to examine separately the complaint under Article 9. The dissenting opinion of Judges Rozakis and Vaji was appended to the judgment.

6. On 12 April 2011 the applicant association requested the referral of the case to the Grand Chamber under Article 43 of the Convention and Rule 75. On 20 June 2011 the panel of the Grand Chamber accepted that request.

7. The composition of the Grand Chamber was determined according to the provisions of Article 26 4 and 5 of the Convention and Rule 24.

Mihai Poalelungi’s term of office expired on 30 April 2012. He continued to sit in the case (Article 23 3 of the Convention and Rule 24 4).

8. The applicant association and the Government each filed further written observations (Rule 59 1). In addition, third party comments were received from the non governmental organisation Article 19, which had been given leave by the President to intervene in the written procedure (Article 36 2 of the Convention and Rule 44 3).

9. A hearing took place in public in the Human Rights Building, Strasbourg, on 16 November 2011 (Rule 59 3).

A. The applicant association and the Raelian Movement

10. The applicant association, which was set up in 1977, is a non profit association registered in Rennaz (Canton of Vaud). It is the national branch of the Raelian Movement, an organisation based in Geneva and founded in 1976 by Claude Vorilhon, known as “Ral”. According to its constitution, its aim is to make the first contacts and establish good relations with extraterrestrials.

11. According to the information available on the applicant association’s website at the time of the adoption of the present judgment, the Raelian Movement’s doctrine is based on Ral’s alleged contact with the “Elohim”,

extraterrestrials with “advanced technology”, who are said to have created life on earth and a number of world religions, including Christianity, Judaism and Islam. The Raelian Movement’s followers believe that scientific and technical progress is of fundamental importance and that cloning and the “transfer of conscience” will enable man to become immortal. In that connection the Raelian Movement has expressed opinions in favour of human cloning.

12. Some texts of the Raelian Movement or works written by Ral himself advocate a system of government called “geniocracy”, a doctrine whereby power should be entrusted only to those individuals who have the highest level of intellect.

13. In his book Sensual Meditation Ral defines this concept as an “instruction manual” given to humans by extraterrestrials, enabling each person “to discover his/her body and especially to learn how to use it to enjoy sounds, colors, smells, tastes, caresses, and particularly a sexuality felt with all one’s senses, so as to experience the cosmic orgasm, infinite and absolute, which illuminates the mind by linking the one who reaches it with the universes he/she is composed of and composes”.

14. The poster in question, measuring 97 cm by 69 cm, featured in the upper part the following wording in large yellow characters on a dark blue background: “The Message from Extraterrestrials”; in the lower part of the poster, in characters of the same size but in bolder type, the address of the Raelian Movement’s website, together with a telephone number in France, could be seen; at the very bottom was the phrase “Science at last replaces religion”. The middle of the poster was taken up by pictures of extraterrestrials’ faces and a pyramid, together with a flying saucer and the Earth.

15. It had been indicated in a French parliamentary report on sects, dating from 1995, and in a judgment of the president of the Civil Court for the district of La Sarine (Canton of Fribourg), that the Raelian Movement engaged in activities that were contrary to public order (ordre public) and immoral.

16. In a decision of 19 December 2001 the municipal council of the city of Neuchtel dismissed an appeal from the applicant association, finding that it could not rely on the protection of religious freedom because it was to be regarded as a dangerous sect. The interference with freedom of expression had been based on Article 19 of the Administrative Regulations for the City of Neuchtel (the “Regulations”); its purpose was to protect the public interest and it was proportionate, since the organisation advocated, among other things, human cloning, “geniocracy” and “sensual meditation”.

17. On 27 October 2003 the Neuchtel Land Management Directorate upheld that decision. It noted that, for the Raelian Movement, life on earth had been created by extraterrestrials, who were also the founders of the various religions and were capable of saving the world, and accepted that this amounted to a religious conviction protected by freedom of conscience and belief. It further accepted that the Regulations constituted a sufficient legal basis in such matters. The Directorate observed that there was nothing offensive in the text and picture on the poster, or in the allusion to extraterrestrials. However, it pointed to the fact that the Raelian Movement advocated “geniocracy” (a political model based on intelligence) and human cloning. Moreover, in a judgment of 13 February 1998 the Fribourg Cantonal Court had found that the movement also “theoretically” advocated paedophilia and incest, especially in the works of Ral himself. The practice of “sensual meditation” could also easily lead to abuse. In addition, the website of Clonaid, to which the Raelian Movement’s site contained a link, offered specific services in the area of cloning, and the notion of eugenics was contrary to the principle of non discrimination. The poster campaign was prejudicial to morals and to the rights of others. In any event, the Raelian Movement had other means by which to disseminate its ideas.

1. The case originated in an application (no. 39401/04) against the United Kingdom of Great Britain and Northern Ireland lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by a British company, MGN Limited (“the applicant”), on 18 October 2004.

2. The applicant was represented by Mr K. Bays of Davenport Lyons, a lawyer practising in London, assisted by Mr D. Pannick QC, Mr K. Starmer QC and Mr A. Hudson, Counsel. The United Kingdom Government (“the Government”) were represented by their Agent, Ms H. Upton.

3. The applicant alleged two violations of its right to freedom of expression guaranteed by Article 10 of the Convention. In particular, it complained about a finding of breach of confidence against it and, further, about being required to pay the claimants costs including success fees.

4. The Government filed written observations (Rule 59 1) on the merits and on the third parties comments (Rule 44 6 and see immediately hereafter) and the applicant responded thereto making also its claims for just satisfaction, to which submissions the Government further responded.

Combined third party comments were received from the Open Society Justice Initiative, the Media Legal Defence Initiative, Index on Censorship, the English PEN, Global Witness and Human Rights Watch, which had been given leave by the President to intervene in the written procedure (Article 36 2 of the Convention and Rule 44 3). The Chamber decided, after consulting the parties, that no hearing on the merits was required (Rule 59 3 in fine).


5. The applicant is the publisher of a national daily newspaper in the United Kingdom known as The Daily Mirror (formerly known as the Mirror). It is represented before the Court by Mr K. Bays of Davenport Lyons, a solicitor practising in London.

6. On 1 February 2001 the “Mirror” newspaper carried on the front page an article headed “Naomi: I am a drug addict”, placed between two colour photographs of Ms Naomi Campbell, a well known model. The first photograph, slightly indistinct, showed her dressed in a baseball cap and had a caption: “Therapy: Naomi outside meeting”. The second showed her glamorously partially covered by a string of beads.

7. The article read as follows:

“Supermodel Naomi Campbell is attending Narcotics Anonymous meetings in a courageous bid to beat her addiction to drink and drugs.

The 30 year old has been a regular at counselling sessions for three months, often attending twice a day.

Dressed in jeans and baseball cap, she arrived at one of NA lunchtime meetings this week. Hours later at a different venue she made a low key entrance to a womenonly gathering of recovered addicts.

Despite her 14million fortune Naomi is treated as just another addict trying to put her life back together. A source close to her said last night: wants to clean up her life for good. She went into modelling when she was very young and it is easy to be led astray. Drink and drugs are unfortunately widely available in the fashion world.

But Naomi has realised she has a problem and has bravely vowed to do something about it. Everyone wishes her well. The story continued inside the newspaper with a longer article across two pages. This article was headed “Naomi finally trying to beat the demons that have been haunting her” and the opening paragraphs read:

“She just another face in the crowd,

but the gleaming smile is unmistakeably Naomi Campbell In our picture, the catwalk queen emerges from a gruelling twohour session at Narcotics Anonymous and gives a friend a loving hug.

This is one of the world most beautiful women facing up to her drink and drugs addiction and clearly winning.

The London born supermodel has been going to NA meetings for the past three months as she tries to change her wild lifestyle. Not the supermodel. Not the style icon.”

9. The article made mention of Ms Campbell efforts to rehabilitate herself and that one of her friends had said that she was still fragile but “getting healthy”. The article gave a general description of Narcotics Anonymous (“NA”) therapy and referred to some of Ms Campbell recently publicised activities including an occasion when she had been rushed to hospital and had her stomach pumped: while she had claimed it was an allergic reaction to antibiotics and that she had never had a drug problem, the article noted that “those closest to her knew the truth”.

10. In the middle of the double page spread, between several innocuous pictures of Ms Campbell, was a dominating picture with a caption “Hugs:

Naomi, dressed in jeans and baseball hat, arrives for a lunchtime group meeting this week”. The picture showed her in the street on the doorstep of a building as the central figure in a small group. She was being embraced by two people whose faces had been masked on the photograph. Standing on the pavement was a board advertising a certain café. The photograph had been taken by a free lance photographer contracted by the newspaper for that job. He took the photographs covertly while concealed some distance away in a parked car.

11. On 1 February 2001 Ms Campbell solicitor wrote to the applicant stating that the article was a breach of confidentiality and an invasion of privacy and requesting an undertaking that it would not publish further confidential and/or private information.

12. The newspaper responded with further articles.

On 5 February 2001 the newspaper published an article headed, in large letters, “Pathetic”. Below was a photograph of Ms Campbell over the caption “Help: Naomi leaves Narcotics Anonymous meeting last week after receiving therapy in her battle against illegal drugs”. This photograph was similar to the street scene picture published on 1 February. The text of the article was headed “After years of self publicity and illegal drug abuse, Naomi Campbell whinges about privacy”. The article mentioned that “the Mirror revealed last week how she is attending daily meetings of Narcotics Anonymous”. Elsewhere in the same edition, an editorial, with the heading “No hiding Naomi”, concluded with the words: “If Naomi Campbell wants to live like a nun, let her join a nunnery. If she wants the excitement of a show business life, she must accept what comes with it”.

On 7 February 2001, the Mirror published, under the heading “Fame on you, Ms Campbell”, a further article mocking Ms Campbell threatened proceedings, referring to the years during which she thrust “her failed projects like the nauseating book Swan and equally appalling record Love and Tears down our throats”, stating that Ms Campbell was not an artist and that she was “about as effective as a chocolate soldier”, implying that her prior campaign against racism in the fashion industry was self serving publicity and that “the problem is that Naomi doesn actually “stand” for anything. She can sing, can act, can dance, and can write.”

B. The substantive proceedings

1. High Court ([2002] EWHC 499 (QB))

13. Ms Campbell claimed damages for breach of confidence and compensation under the Data Protection Act 1998. A claim for aggravated damages was made mainly as regards the article of 7 February 2001. On 27 March 2002 the High Court (Morland J.) upheld Ms Campbell claim, following a hearing of 5 days.

1. The case originated in an application (no. 33014/05) against Ukraine lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by the editorial board of the newspaper Pravoye Delo (“the first applicant”) and a Ukrainian national Mr Leonid Isaakovich Shtekel (“the second applicant”) on 22 August 2005.

2. The applicants were represented before the Court by Ms L. V. Opryshko, a lawyer practising in Kyiv. The Ukrainian Government (“the Government”) were represented by their Agent, Mr Y. Zaytsev, of the Ministry of Justice.

3. On 13 October 2009 the President of the Fifth Section decided to give notice of the application to the Government. It was also decided to examine the merits of the application at the same time as its admissibility (Article 29 1).


4. The first applicant is the editorial board of Pravoye Delo, a newspaper officially registered in Odessa in May 2000. The second applicant is the editor in chief of Pravoye Delo. He lives in Odessa.

5. At the material time Pravoye Delo was a local newspaper published three times a week with a circulation of 3,000 copies. It published reports and material on political and social matters in Ukraine and, in particular, the Odessa Region. Due to lack of funds, the newspaper often reprinted articles and other material obtained from various public sources, including the Internet.

6. On 19 September 2003 Pravoye Delo published an anonymous letter, allegedly written by an employee of the Security Service of Ukraine, which the second applicant’s colleague, Ms I., had downloaded from a news website. The letter contained allegations that senior officials of the Odessa Regional Department of the Security Service had been engaging in unlawful and corrupt activities, and in particular that they had connections with members of organised criminal groups. One of the paragraphs of the letter read as follows:

” The Deputy Head of [the Odessa Regional Department of the Security Service] [I. T.], a close friend and assistant of the Head of the Department P., established ‘business’ contacts with [the organised criminal group] of [A. A.] A member of [the organised criminal group] G. T., an agent of [A. A.], who is in charge of the main areas of activities of the gang [is] a coordinator and sponsor of murders, [he] meets with [I. The letter was followed by these comments, prepared by Ms I. on behalf of the editorial board:

“When publishing this letter without the knowledge and consent of the editor in chief, I understand that I may not only face trouble but I may also create problems for the newspaper. Because, if this letter is [misinformation], then [the media], in which it appears may be endangered. Moreover, [it is to be noted] that the Department [of the Security Service] in the Odessa Region did not react to an analogous publication in the Top Secret [newspaper] I remind [you] that the [Pravoye Delo] newspaper is wide open for letters in reply and comments from all interested agencies.”

8. In October 2003 G. T., who lived in Odessa at the time and was the President of the Ukraine National Thai Boxing Federation, brought defamation proceedings in the Prymorskiy District Court of Odessa against the applicants. G. T. alleged that the information in the 19 September 2003 issue of Pravoye Delo concerned him, and that it was untrue and had damaged his dignity and reputation. He asked the court to order the applicants to publish a retraction and an apology and to pay him compensation for non pecuniary damage in the amount of 200,000 Ukrainian hryvnias (UAH).

9. The applicants first argued before the court that they were not responsible for the accuracy of the information contained in the material that they had published, as they had reproduced material published elsewhere without making any modifications. The publication contained a reference to the source of the material and was followed by comments explaining the editors’ position regarding the material and inviting comments from the persons and bodies concerned. The applicants also submitted that if the court were to award G. T. the amount of compensation he had claimed, the newspaper would become insolvent and would have to close.

10. Subsequently, at a hearing on 24 April 2004, the second applicant stated that the article was not about the claimant and that its wording did not necessarily establish that it was a particular “G. T.” who was being referred to.

11. On 7 May 2004 the court ruled against the applicants. It found that the information at issue did concern the claimant, who was a public figure involved in public activities in the Odessa Region and had represented Ukraine at sports events abroad in his capacity as President of the Ukraine National Thai Boxing Federation. In that context, the court noted that this had not been contested by the applicants in their initial submissions and that the publication was about the activities of the Security Service in the Odessa Region. The court further held that the content was defamatory and that the applicants had failed to prove that it was true. It found no grounds on which to exempt the applicants from civil liability under section 42 of the Press Act, as the Internet site to which they had referred was not printed media registered pursuant to section 32 of the Press Act.

12. The court ordered the first applicant to publish a retraction of the following content of the publication:

” A member of [the organised criminal group], G. T., an agent of [A. A.], who is in charge of the main areas of activities of the gang [is] a coordinator and sponsor of murders, [he] meets with [I. The court further ordered the second applicant to publish an official apology in the newspaper.

14. In determining the amount of compensation to be paid to the claimant, the court considered the submissions of the latter and the information concerning the financial situation of the newspaper. It noted that its gross annual income was about UAH 22,000 and found it reasonable to order the applicants jointly to pay G. T. UAH 15,000 for non pecuniary damage. The applicants were also ordered to pay to the State Budget UAH 750 in court fees.

15. The applicants appealed. They maintained the submissions they had made before the first instance court and also contended that the editorial board had not been registered as a legal entity pursuant to the relevant regulations on registration of the media and that the second applicant had not been appointed as editor in chief in accordance with the law. Thus, in their view, they could not take part in the proceedings.

16. The applicants further argued that invoking their civil liability was contrary to section 41 of the Press Act and section 17 of the Act on State Support of Mass Media and Social Protection of Journalists, stating that they had not intended to defame G. T. and that, by publishing the material, they had wished to promote public discussion of the issues raised in that material which were of significant public interest. According to them, it was their duty to disseminate the material and the public had a right to receive it.


18. On 14 September 2004 and 24 February 2005, respectively, the Odessa Regional Court of Appeal and the Supreme Court rejected the applicants’ appeals and upheld the judgment of the first instance court.

19. On 3 July 2006 the applicants and G. T. concluded a friendly settlement agreement, pursuant to which the latter waived any claim in respect of the amount of compensation awarded in the judgment of 7 May 2004. The applicants, for their part, undertook to cover all the costs and expenses relating to the court proceedings and to publish in Pravoye Delo promotional and informational materials at G. T.’s request, the volume of which was limited to the amount of compensation under the judgment.

20. In 2008 the applicants discontinued publishing Pravoye Delo.

We report the case of a 30 year old right handed woman who presented with a more than 24 month history of progressive right wrist pain. No history of trauma was reported. Conservative treatment with anti inflammatory medications before referral was unsuccessful. Examination revealed a small palpable mass in the carpal navicular region with no limitation of normal wrist motion. An IOG cyst of the scaphoid was found on standard radiograph and CT scan of the wrist. Treatment consisted in curettage of the cyst followed by packing of the defect with autologous cancellous bone graft harvested in the distal end of the radial metaphysis. Satisfactory functional recovery was achieved. have been reported. We report a case of IOG cyst of the scaphoid carpal bone. During that period, the patient had received multiple symptomatic treatments associating antalgic, non steroidal anti inflammatory drugs combined with periodical wrist immobilization but no improvement was observed. Symptomatology became permanent the last 2months. Clinical examination revealed a moderate swelling over the mid section of the palmar face and pain through extreme ranges of motion of the wrist. Wrist motion was not limited. Blood examination was unremarkable. Radiographic studies of the right wrist revealed a round shaped defect of the proximal part of the scaphoid (Figure 1). This lesion was solitary, well defined, with a thin sclerotic margin and no cortical defect. The adjacent joints were normal. Computed tomography revealed a lucent area within the scaphoid with communication between the cystic lesion and the adjacent joints. Other carpal bones were normal in shape and of homogeneous density (Figure 2). The patient underwent surgery through an anterior approach of the scaphoid bone combined with arthrotomy and lesion localization was performed using a wire under image intensifier. The cyst was visible through bone trephination and was of gelatinous and typical yellowish appearance. Thorough intralesional curettage of the scaphoid cavity followed by packing of the defect with cancellous bone graft harvested from the distal aspect of the radial metaphysis were performed. The bacteriological analysis for specific and common germs was negative. The content of the cyst was described anatomopathologically as a cystic formation with walls constituted by flattened, synovial like, fibroconnective tissue cells with no true epithelial lining. Neither mucoid nor myxoid degeneration was observed. A removable splint was applied for 3weeks for wrist immobilization. At 4 year follow up, pain had disappeared and the wrist demonstrated stable normal mobility (Figure 3). In most series, intraosseous ganglia have been reported to be located in the lower limb, and mainly occur in the epiphysometaphyseal part of the femur and tibia.

Pathogenesis of IOG cysts still remains controversial. There are two opposing theories: the idiopathic or primary intraosseous lesion is due to an intramedullary metaplasia of mesenchymal cells into synovial like cells or ischemic bone necrosis resulting from mechanical stress or repeated microtraumatisms. Due le ipotesi: che nell’accesa lite il 61enne possa essere stato vittima di un malore, ma anche che possa essere stato colpito in maniera fatale. Marina Elide Punturieri, coniugata Ripa di Meana e precedentemente nota come Marina Lante della Rovere, conosciuta anche per i matrimoni con Alessandro Lante della Rovere, prima, e con Carlo Ripa di Meana, poi, si è spenta oggi all’età di 76 anni, scrive l’Ansa dopo che Dagospia ha dato per prima la notizia alla stampa. Come riferisce il sito gestito da Roberto D’Agostino, questo sarà il mio ultimo Natale, aveva raccontato la stessa Marina agli amici più stretti nei giorni scorsi. Come solo in Italia può avvenire decolla in questi primi giorni del 2018 la polemica sui sacchetti bio. Grave episodio di cronaca a Palermo, dove una piccola bimba di un anno e mezzo è stata ricoverata dopo aver ingerito una piccola quantità di hashish.
